In those cases, you are responsible for providing your own privacy notices and obtaining any required consents. NextAIQ processes that information to provide the Services and as described in this Privacy Policy.

2. Information We Collect

We collect information in three main ways: (a) information you provide, (b) information collected automatically, and (c) information from integrations/third parties you connect.

2.1 Information You Provide

Account and Contact Information. Name, company name, address, phone number, email address, and similar information you provide when you inquire about, purchase, or use the Services.

Billing Information. Payment and billing details (such as billing name and address). Payment transactions are processed by third-party payment processors. NextAIQ does not store full payment card numbers on its servers.

Customer Content and Configuration Data. Information you upload or create in the Services, such as business information, logos, images, templates, scripts, messages, contact lists, workflows, configuration settings, and other data you choose to store or process using the Services ("Customer Data").

2.2 Information Collected Automatically

Device and Usage Data. Information about how you access and use the Services, including browser type, device identifiers, IP address, pages or screens viewed, links clicked, timestamps, and referring/exit pages.

Cookies and Similar Technologies. We and our service providers may use cookies, pixels, and similar technologies to operate the Services, remember preferences, understand usage, and improve performance.

2.3 Information from Integrations and Third Parties

If you connect third-party services (such as communications providers, AI vendors, analytics, or other tools) to the Services, we may receive information from those services as necessary to enable the integration you choose.

3. How We Use Information

We use information to:

Provide, operate, maintain, and improve the Services;

Create and manage accounts and support requests;

Process payments and administer subscriptions;

Enable integrations and communications features you configure;

Monitor performance, protect the Services, and prevent fraud or misuse;

4. How We Share Information

We do not sell your personal information.

We may share information in the following circumstances:

Service Providers. With vendors who help us run our business and provide the Services (e.g., hosting, analytics, payment processing, support tooling), under contractual obligations consistent with this Privacy Policy.

Integrations You Enable. With third-party services you connect or instruct the Services to use (e.g., communications providers, AI vendors, content/voice providers, or other integrated tools), to deliver the functionality you choose.

Third-Party Terms and Policies. Third parties you enable may process information under their own privacy policies and terms. You are responsible for reviewing and accepting those terms and for configuring integrations in a way that aligns with your privacy obligations.

Legal and Safety. If we believe disclosure is required by law, legal process, or to protect the rights, safety, and security of NextAIQ, our customers, or others.

Business Transfers. In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, where information may be transferred as part of that transaction.

Aggregated/De-Identified Data. We may share aggregated or de-identified information that cannot reasonably identify an individual.

5. Cookies and Analytics

Cookies help us operate the Services and understand usage. You can control cookies through your browser settings. If you disable cookies, some features may not function properly.

5.1 Cookie Categories

Essential cookies. Help the Services function (for example, authentication and security).

Analytics cookies. Help us understand usage and improve performance.

Marketing cookies (if enabled). We may use marketing/advertising cookies or pixels in the future to measure campaigns and deliver relevant ads. If we enable marketing cookies, we will update this Privacy Policy and/or provide additional notice where required.

5.2 Analytics Providers

We may use analytics providers to help us understand how the Services are used.

6. Service Providers

We use service providers to operate and improve the Services. Some of these vendors may process personal information on our behalf under contractual obligations consistent with this Privacy Policy.

Communications Provider. We may use Twilio as a communications provider in connection with messaging and voice features you enable.

Payment Processing. Payments are processed by third-party payment processors (such as Stripe). NextAIQ does not store full payment card numbers on its servers.

AI and Voice Providers. We may use Assistable and ElevenLabs in connection with AI-assisted features and voice functionality you enable.

Platform Infrastructure. The Services may rely on third-party infrastructure and tools to host, operate, and secure the Platform. We do not publish an exhaustive list of infrastructure vendors in this Privacy Policy. When appropriate, we may provide additional vendor details through the Platform or support resources.

We may use additional service providers over time. For transparency, we may disclose additional key service providers through updates to this Privacy Policy and/or within the Platform. When appropriate, we may also provide additional vendor details through support resources.

7. AI and Automated Processing

The Services may include automation and AI-assisted features.

Your instructions and configuration. You control whether and how AI/automation features are used through your configurations and workflows.

NextAIQ use of Customer Data for AI. NextAIQ processes Customer Data to provide the Services. NextAIQ does not use Customer Data to train generalized AI models for others unless you instruct us to do so or we expressly agree with you in writing.

Third-party AI vendors. If you enable integrations with third-party AI vendors (including optional integrations beyond the providers listed in Section 6), those vendors may process information under their own privacy policies and terms. Depending on your configuration, this may include model providers surfaced in the Platform (such as OpenAI, Anthropic/Claude, and Google/Gemini). You are responsible for reviewing and accepting applicable third-party terms and for configuring integrations in a way that aligns with your privacy obligations.

8. Data Retention

We retain information for as long as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information and how it is used.

If you terminate your account, Customer Data may no longer be accessible. We may delete or remove Customer Data in accordance with our then-current data retention practices, subject to applicable law and any written agreement between you and NextAIQ.

9. Security

We use reasonable administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

10. Your Choices and Rights

Depending on your location and applicable law, you may have rights to access, correct, delete, or obtain a copy of certain personal information, and to object to or restrict certain processing.

End-Customer Requests. If you are an end customer of one of our customers (for example, you received a message, call, or email from a business that uses NextAIQ), please contact that business directly. That customer controls your information in their account and is responsible for handling your request.

Requests to NextAIQ. If you are a direct customer or user of NextAIQ and want to make a privacy request related to your NextAIQ account, you may contact us using the methods in Section 14. We may need to verify your identity before processing requests.

11. International Transfers

We may process and store information in the United States and other locations where our service providers operate. By using the Services, you understand that your information may be transferred to and processed in these locations.

12. Children’s Privacy

The Services are intended for business use and are not directed to children under 13. We do not knowingly collect personal information from children under 13.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will post the updated policy and update the "Last Updated" date.
